What is ATE Insurance?

ATE (After the Event) insurance, also called litigation insurance, is a policy that may protect claimants from certain financial risks if their case is unsuccessful. It is typically arranged by your solicitor, not by TC Legal.

  • It can cover the opposing party’s legal costs if your claim fails.
  • It may also cover disbursements, such as court fees or expert witness expenses.
  • It supports solicitors in offering “no win, no fee” services by reducing exposure to risk.

When is ATE Insurance Used?

ATE insurance is commonly used in:

  • Personal injury cases (road accidents, workplace injuries, slips & falls)
  • Medical negligence claims
  • Situations where you do not hold existing insurance (e.g. BTE) or where your BTE insurance has gaps
     

All application of ATE depends on the solicitor’s assessment and the policy terms.

Who Benefits from ATE Insurance?

You may benefit from ATE insurance if:

  • You do not have relevant legal expense cover (e.g. BTE)
  • You are pursuing a case that involves significant risk or costs
  • Your solicitor considers ATE to be appropriate after evaluating your claim

Role of Solicitors & Your Next Steps

  • Solicitors we connect you with can assess whether ATE insurance is suitable in your case.
  • They will explain costs, premiums, and terms before you decide whether to proceed.
  • If valid, the solicitor may arrange ATE insurance as part of your claim strategy.
  • Your decision on ATE is yours — it is not guaranteed that it will be appropriate or available.
